First, what is Defamation?

Defamation entails a situation where a person (whether natural or artificial) makes a statement either orally_ Which is Slander since it is in non-permanent form and will be actionable once there are witnesses to the statement_ or puts the statement down in writing or in any other medium that has permanence… The operative word here is Permanent Medium. That will amount to libel.

There is a video that has been going the rounds on the Internet in several user-uploaded porn sites. In the video, a man is engaged in the sex act with two women in plain view of the camera.

Many people living in Nigeria and other parts of the world has declared that one of the women in the video is Nigerian Nollywood actress Genevieve Nnaji. This information has been flying around the Information Superhighway for years, and it has garnered a lot of publicity and notoriety which the budding actress may or may not be aware of.

Many bloggers have blogged about this, some of them accusing the star without taking a critical look at the lady in the video who, though is a dead ringer for Genevieve Nnaji, is actually African-American porn actress, Nyomi Banxxx, or Naomi Banxxx, which are the names by which she’s known. Some bloggers has seen the dissimilarities between the two women and pointed it out in their posts. Others, however, have not; to them, the woman in the flick is Genevieve Nnaji.

Stemming from the above, it can be said easily that the actress has been defamed. Libelous publications has been made against her, which can tarnish her image in the eyes of right-thinking members of the community.

Action

Should the actress choose, she can maintain an action jointly and severally against all the persons who have written about that porn flick negatively, pointing fingers at her as the actress in the movie. After all, she’s not the person in the movie and they said it is her.

It does not matter if the site owner is the person who wrote the information in his or her site; what matters is the publication of the scandalous, libelous statement which is Defamation to the name and image of the actress… What is important is that the person has caused to be written and published, on his Web space in cyberspace, with his consent, regardless of whether or not he is the one that had written the article, information that is permanently etched in the indelible markers of cyberspace, and which, in this case, as Is palpably obvious, has defamed the character of the Nollywood actress.

The actress has an actionable remedy against these persons in Defamation, for which she can claim millions in damages.

NB: many celebrities have, in the past, sued defamers that had published libelous statements against their characters in the Media and been awarded huge sums of money to compensate for the aforementioned defamation.

Final Summation

People have the right to dispense whatever information they wish, but should that information infringe on the rights of another person, then that right becomes a liability. For, in Law: your right stops where mine starts.
